Estate Litigation

The law in British Columbia is structured in a such a way so as to protect spouses and children and ensure that they are properly taken care of by a deceased spouse or parent.  A Will may, however, expressly exclude a spouse or a child if that person had been properly provided for during the Will-maker’s lifetime.

Under the Wills, Estates and Succession Act of British Columbia, spouses and children of a deceased person may essentially challenge a Will.
